These Terms & Conditions constitute a binding legal agreement (“Agreement”) between you (“you,” “your,” or “yours”) and Gotron Technology LLC and its affiliates (“GOTRON,” “we,” “us,” or “our”). This applies to your use of the GOTRON app, website, and the platform (“GOTRON Platform”) and our services (“Services”). Please read this carefully before accessing or using our Services.
Dispute Resolution:
This Agreement includes provisions that require resolving any claims through binding individual arbitration—excluding class, group, or representative actions. A neutral arbitrator will determine rights, not a court or jury. By accepting this Agreement, you acknowledge understanding and agreeing to these terms. If you do not agree, do not access the GOTRON Platform or use our services.
I. The GOTRON Platform
GOTRON operates as a marketplace for:
– Consumers (“GOTRON Consumers”) to request delivery and transportation services, including associated products and rides.
– To connect Consumers and their authorized guests (including minors) with our fleet of vehicles and employee drivers (“Drivers”).
Account Creation:
– Each person may only create one GOTRON Customer profile.
– GOTRON reserves the right to deactivate any additional profiles.
– By creating an account, you authorize GOTRON to match your trip requests based on location, destination, preferences, and platform efficiency.
– You accept services at your discretion and agree to all terms when requesting services.
Security & Video Recording:
– All persons (including minors) inside and near GOTRON vehicles are continuously video recorded for safety.
– GOTRON owns all recordings and securely maintains them per our Privacy Policy
(https://gogotron.com/privacy-policy).
– By requesting or using our services, you consent to this recording on behalf of yourself and all invited persons.
– You are responsible for informing others about recording and securing their consent before entering a vehicle.
Section II. Modification of Terms
GOTRON reserves the right to revise these Terms & Conditions at any time without prior notice. Any updates or new terms become effective immediately upon posting. It is your responsibility to review the latest version periodically. Continued use of the GOTRON Platform or Services after changes indicates your acceptance of those updates.
Section III. Eligibility and Authority
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create a GOTRON account, unless specified otherwise. By registering, you affirm that you have the legal capacity to enter into this Agreement and that all information provided is accurate. You cannot transfer or assign your account to others.
If you are using the Services on behalf of another individual or organization, you confirm that you are authorized to do so and accept this Agreement on their behalf. You agree to defend and hold harmless GOTRON against any claims arising from misrepresentation of authority or misuse of the services, including use by minors or guests.
GOTRON may provide services to unaccompanied minors aged 13-17 with prior parental or guardian consent, which you must obtain. Service is not available for children under 13. You warrant that you have obtained necessary consent before requesting services for minors, and that minors requiring booster seats are accompanied by an adult; GOTRON drivers do not assist with installing or buckling booster or car seats.
Section IV. GOTRON Guild Membership
By subscribing to the GOTRON Guild via the app, you agree to pay the membership fee (& Member Subscription Fee") in exchange for benefits such as discounts, priority access, and special privileges, which may change over time. For recurring monthly memberships, the fee will be automatically charged unless canceled before the current billing cycle ends.
All memberships are non-refundable. GOTRON may adjust subscription prices with prior notice and continued use of the platform after a price change signifies acceptance. If you disagree with the new price, you may opt out by unsubscribing before the change takes effect. Please read the notifications carefully to stay informed.
V. Trip Charges
As a GOTRON customer, you understand that, in addition to any Member Subscription Fee (if applicable), your use of our Services will incur charges (“Trip Charges”). These include:
Fares: The estimated cost based on trip distance and duration, which may vary at the end of the trip. The final fare is calculated via GPS data and includes applicable taxes.
Wait & Shopping Charges: Fees for time spent waiting, shopping, or completing errands beyond the free wait time, charged per minute.
Goods & Services Purchases: Costs for items or services bought by GOTRON drivers on your behalf, billed at full value plus a processing fee.
Service Fees: A 15% charge on the Fare and any Wait/Shopping charges, supporting operational costs.
Cancellation Fees: Fees applicable if you cancel after requesting a trip or fail to show up at the pickup location.
Damage Fees: Up to $500 (based on damage assessment) for vehicle damage caused during your trip.
Pricing & Payments:
All charges are processed exclusively through our third-party provider, Stripe, and cash payments are not accepted.
All charges are non-refundable, although GOTRON may issue credits or refunds at its discretion.
Promotional coupons may reduce charges but are subject to specific terms, cannot be combined, and are only valid on the platform.
When adding a new payment method or requesting a trip, your payment method may be authorized to verify funds. This authorization is not a charge but may temporarily reduce your available credit.
Receipts:
After each trip, a detailed receipt—including trip origin, destination, time, distance, and fare breakdown—will be sent via email, text, or directly through the app.
In case of cancellation, the receipt will reflect any applicable fees or charges.
VI. GOTRON Communications
By using the GOTRON Platform, you agree to receive notifications from us via email, text, calls, and push alerts. These may include automated messages, updates about your account, new features, promotions, industry news, and service updates. Standard message and data rates may apply.
You may opt out of promotional texts by replying “STOP,” and we will send a final confirmation message. You may also unsubscribe from promotional emails directly within those emails.
Participation in our communications is voluntary and not a condition of using the services. To stop all texts or calls, contact us at greetings@gogotron.com, specifying your phone number. Be aware that opting out may impact your access to the platform.
VII. Your Data & Privacy
Your “Information” includes any data you provide, post, or share through the GOTRON Platform—such as profile details, feedback, messages, or social media posts. You grant us permission to use your Information to create your account and enable your participation.
We handle your data according to our Privacy Policy (https://gogotron.com/privacy-policy), and you are responsible for ensuring your profile information is accurate and current.
You agree that GOTRON may use, reproduce, display, or distribute your Information solely for platform-related purposes, in perpetuity, worldwide, and royalty-free. You retain ownership of your data but grant GOTRON essential rights to operate and improve our services.
VIII. Promotions & Referral Programs
GOTRON may offer promotions or discounts at its discretion. These offers are independent of your relationship with GOTRON and may be canceled or adjusted if misuse or fraud is suspected.
Our Referral Program rewards you for inviting friends to use GOTRON, offering incentives such as credits or discounts. Terms, conditions, and rewards are set at GOTRON’s sole discretion and can change without notice. Participation is subject to this agreement and specific program rules.
IX. Code of Conduct
All users and guests must follow safety and community guidelines:
Wear seatbelts at all times; children must be secured in appropriate Child Seats. Drivers will not assist with installation.
Do not engage in illegal activities, harassment, or discrimination.
Do not impersonate others, post offensive content, or infringe on intellectual property.
Do not disrupt our platform, use bots, or transmit malicious software.
Do not transfer accounts, sell access, or mine platform data.
Harassment, discrimination, or illegal acts will result in account suspension or termination.
X. Driver Policies
GOTRON maintains a strict non-discrimination policy. Drivers are prohibited from:
Discriminating based on a rider’s or potential rider’s location, destination, race, color, national origin, religion, sex, disability, or age.
Refusing service to a potential rider who has a service animal.
GOTRON enforces a Zero-Tolerance policy for the use of alcohol or drugs by drivers.
If you suspect a driver is under the influence, ask the driver to end the trip immediately and report the incident promptly to greetings@gogotron.com.
XI. Intellectual Property
All intellectual property rights in the GOTRON Platform—including copyrights, trademarks, design rights, and database rights—are owned entirely by GOTRON.
You do not acquire ownership of any security recordings from vehicles; they remain the property of GOTRON and are used solely for safety and security purposes.
Any submissions or feedback you provide are non-confidential and become the exclusive property of GOTRON.
Our logos, designs, graphics, icons, and service names are protected trademarks owned by GOTRON.
You may not use or reproduce them without prior written permission.
If you believe your rights have been infringed, please contact greetings@gogotron.com.
XII. Disclaimers
Use of the GOTRON Platform and services is at your own risk. GOTRON is responsible solely for its own vehicles and operations and is not liable for third-party conduct, weather, or other factors beyond our control.
The platform is provided “as is,” with no warranties regarding accuracy, reliability, or virus-free operation.
GOTRON disclaims liability for any damages—direct, indirect, or consequential—resulting from service use or interruptions.
Your sole remedy for dissatisfaction is to cease using the platform.
XIII. Indemnity
You agree to defend, indemnify, and hold harmless GOTRON and its affiliates from any claims, damages, or costs arising from your or your guests’ use of the platform, including breaches of this agreement or violations of others’ rights.
This indemnity applies except where claims result from GOTRON’s negligence or misconduct.
XIV. Limitation of Liability
To the fullest extent permitted by law, GOTRON is not liable for incidental, special, consequential, or indirect damages, including data loss or service interruptions.
Our total liability in any claim is limited to the amount you paid us in the previous 12 months, not exceeding $5,000.
XV. Termination
We reserve the right to suspend or terminate your account for payment issues or policy violations.
You may cancel your account at any time by written request, but no refunds will be issued for paid subscriptions.
Upon termination, your account data may be deleted, and you will lose access to the platform. These terms remain effective even after termination.
XVI. Dispute Resolution and Arbitration Agreement
(a) Agreement to Arbitrate:
By using the GOTRON platform, you and GOTRON agree to resolve all disputes through binding arbitration rather than court.
No class actions are permitted.
All claims must be handled individually.
Arbitration applies to disputes relating to this Agreement, privacy policy, or service use.
(b) Arbitration Rules:
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitrator may only hear individual claims and cannot preside over class actions.
Arbitration awards are final and binding.
(c) Fees and Costs:
If you initiate arbitration, your share of the filing fee is capped at $50 for claims under $5,000; GOTRON covers the rest.
Each party bears its own legal costs unless otherwise provided by law.
(d) Location & Method:
Unless otherwise agreed, arbitration will be held in Texas.
For claims under $10,000, you may choose document-based, phone, or in-person arbitration.
(e) Liability Cap:
The maximum liability of GOTRON is limited to the total amount you paid us in the 12 months prior to the claim, up to $5,000.
XVII. Confidentiality
You agree not to disclose GOTRON’s confidential or proprietary information, including driver details or internal processes, except as required by law or for service use.
If disclosure is legally required, notify GOTRON promptly.
XVIII. General
This Agreement is governed by the laws of the State of Texas, without regard to its conflict of law principles.
If any provision is found invalid, the remaining provisions remain in effect.
GOTRON may assign this Agreement without notice.
